{"id":3229,"date":"2018-03-28T21:39:13","date_gmt":"2018-03-29T01:39:13","guid":{"rendered":"http:\/\/sites.nd.edu\/entrepreneurlaw\/?p=3229"},"modified":"2018-03-28T21:40:22","modified_gmt":"2018-03-29T01:40:22","slug":"3229","status":"publish","type":"post","link":"https:\/\/sites.nd.edu\/entrepreneurlaw\/2018\/03\/28\/3229\/","title":{"rendered":"Patenting Antibodies: Obviousness Considerations"},"content":{"rendered":"<p>This <a href=\"http:\/\/www.ipwatchdog.com\/2018\/02\/27\/patenting-antibodies-obviousness\/id=94024\/\">arti<\/a><a href=\"http:\/\/www.ipwatchdog.com\/2018\/02\/27\/patenting-antibodies-obviousness\/id=94024\/\">cle<\/a> analyzed a few cases in which antibody-related claims were challenged for obviousness.\u00a0Under\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/103\" target=\"_blank\" rel=\"noopener\">35 U.S.C. \u00a7 103<\/a>, a claim is not patentable if the \u201cdifferences between the claimed invention and prior art are such that the claimed invention as a whole would have been obvious\u201d to a person of ordinary skill in the art, before the effective filing date of the claimed invention.\u00a0This article analyzes obviousness issues related to antibody patents at the Patent Trials and Appeal Board (PTAB) and in federal courts.It shows that method of treatment attracts the most patent claims.
